Consumer (ACL)

For the purposes of the Australian Consumer Law (ACL), a person (including a corporation) who acquires:
  • Goods, where one or more of the following applies:
    • the amount paid or payable does not exceed $100,000 (prior to 1 July 2021, the threshold was $40,000);
    • the goods are of a kind ordinarily acquired for personal, domestic or household use or consumption; or
    • the goods consist of a vehicle or trailer acquired for use principally in the transport of goods on public roads.
  • Services, where one or both of the following applies:
    • the amount paid or payable does not exceed $100,000; or
    • the services are of a kind ordinarily acquired for personal, domestic or household use or consumption.
For the purposes of the ACL, a person (including a corporation) is not a consumer, if goods are acquired:
  • For re-supply (but if the goods are gift cards, only if the re-supply is in trade or commerce).
  • To be used, in trade or commerce, as a part of a production or manufacturing process or to repair goods or fixtures on land.
The term consumer can have different meanings in other contexts in the Competition and Consumer Act 2010 (Cth) (see Consumer).
