by Practical Law Insolvency and Restructuring and reviewed by Michael Murray
This note considers the powers of a trustee in bankruptcy to realise and otherwise deal with assets. It addresses the trustee's power to deal with the bankrupt's assets generally, including to realise those assets, and the assignment of rights of action held by the bankrupt and the trustee (respectively). It also considers directions that the court may make in relation to the administration of the estate, and the circumstances in which the administration of the estates of two or more partners or two or more joint debtors can be consolidated.
