On 26 September 2022, the Crimes Legislation Amendment (Ransomware Action Plan) Bill 2022 (Cth) (CLARAP Bill 2022) was reintroduced to federal Parliament as a private member's bill following its lapsing in April 2022 as a result of the dissolution of parliament due to the federal election. The CLARAP Bill 2022 would amend the Criminal Code Act 1995 (Cth), the Crimes Act 1914 (Cth) and the Proceeds of Crimes Act 2022 (Cth) with the aim of modernising criminal offences and procedures in response to the increasing threat of ransomware attacks in Australia. This update provides a brief background and overview of the proposed legislation.
