Application of the unfair contract terms regime to property transactions

This note considers the application of the unfair contract terms regime under the Australian Consumer Law to the sale of land and retail and commercial leasing. It provides examples of potentially unfair terms, discusses the consequences of having an unfair term in a contract and how to avoid breaching the unfair contract terms regime.
